Terms of Service

Last updated 23 October 2026

These terms apply when you use Mapeni Pay at mapenipay.com, the shop sites we host, and related services (together, "the service"). By creating an account or using the service you agree to them. If you use it for a business, you agree on that business's behalf.

1. The service

Mapeni Pay lets businesses sell online and get paid: shop websites, payment links and checkouts, quotations and invoices, WhatsApp ordering and messaging tools, and tools to post product videos to the business's own social accounts such as TikTok. Features differ by plan.

2. Your account

  • You must be 18 or older and give accurate details.
  • Keep your sign-in secure. You are responsible for what happens under your account.
  • Tell us at info@mapenipay.com if you think your account has been misused.

3. Payments and money

Customer payments go directly to your own M-Pesa Paybill or Till, or to the payment account you connect. Mapeni Pay does not hold your money. You are responsible for your prices, taxes, refunds, delivery and customer service. Subscription and messaging fees are shown in the dashboard before you pay and are not refundable except where the law requires.

4. What you may sell and post

  • Only lawful goods and services, with any licences they need in Kenya.
  • Only content you own or have the right to use — photos, videos, music and text.
  • No misleading claims, fake reviews, spam, or anything that infringes others' rights.

5. Connected platforms (WhatsApp, Facebook, TikTok, Google)

When you connect a third-party account, you authorise Mapeni Pay to act on it as you direct — for example, to send WhatsApp messages from your business number or to post a video to your TikTok account when you press Post. Your use of those platforms is also governed by their own terms, including TikTok's Terms of Service and its Music Usage Confirmation and Branded Content Policy, and WhatsApp's Business and Commerce policies. You are responsible for the content you post and for disclosing paid or promotional content as those platforms require. You can disconnect an account at any time from the dashboard. A platform may limit or withdraw features, which may change what Mapeni Pay can do.

6. Your data and your customers' data

You own your business data. You let us host and process it to run the service, as described in our Privacy Policy. For your customers' personal data you are the controller and must have a lawful basis to collect and message them.

7. Acceptable use

Don't break the law, try to access other accounts, interfere with the service, scrape it, or use it to send unsolicited bulk messages. We may suspend accounts that put customers, other merchants or the service at risk.

8. Ending the service

You can stop using Mapeni Pay at any time. We may suspend or close an account that breaks these terms, with notice where reasonable. Sections 3, 6, 9 and 10 survive closure.

9. Disclaimers and liability

The service is provided as is. We work to keep it available and accurate but don't guarantee it will be uninterrupted or error-free, or that third-party platforms and payment networks will be. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the three months before it arose.

10. Law

These terms are governed by the laws of Kenya, and disputes go to the courts of Kenya.

11. Changes

We may update these terms. We'll post changes here and update the date above; material changes are announced in the dashboard.
